REACH CERTIFICATION
REACH (CHEMICAL MANAGEMENT AND SAFETY RULES)
“REACH” also known as “Chemical (Management & Safety)” Rules 2021, is a National Chemical Law. REACH compliance provides for Notification, Registration, Restrictions or prohibitions, and labelling and packaging requirements related to the use of substances, substances in mixtures, and Intermediates placed or intended to be placed in India.
The objective of REACH Compliance is to ensure a high level of protection to human health and the environment through better and earlier identification of intrinsic properties of Substance, Mixture.
The main reason for adopting and developing REACH compliance and regulation in place of the existing Manufacture, Storage, and Import of hazardous chemicals rule 1989 is that a large number of substances have been manufactured and placed in the Indian market, sometimes in very high amounts. There is insufficient information on the hazards that they pose to human health and the environment.
INDIA REACH (CHEMICAL MANAGEMENT AND SAFETY RULES)
REACH is chemical management, and safety rules provide for Notification, Registration, and Restriction or Prohibition of Priority Substances, Mixture, Intermediates placed in Indian territory.
REACH refers to Registration, Evaluation, Authorization, Restriction of chemical substances, Mixture, Intermediates. REACH is also named as Chemical (Management and Safety) Rules, which will replace existing Manufacture, Storage and Import of Hazardous Chemicals (MSIHC) Rule 1989 and Chemical Accidents (Emergency Planning, Preparedness, and Response) (CAEPPR) Rules 1996.
REACH compliance provides for safety procedures for the Manufacture, Storage, Handling, and Import of Priority Substances and preparedness and management of Chemical Accidents related to Priority Substances, as identified under these Rules.
INDIAN REACH COMPLIANCE
India REACH regulation shall be applicable on Indian Importers, Indian Manufacturers, Foreign entity of Priority Substance, Mixture, Intermediates, and Articles.
REACH regulation applies to all Substances, Substances in Mixtures, and Intermediates Manufactured, Imported, Placed, or intended to be Placed in India. No person shall place any Substance, Mixture, or Article in Indian territory unless they comply with these rules.
REACH compliance Certificate is necessary for all manufacturers, importers who have placed or intended to place any priority substance in Indian territory.
REACH COMPLIANCE REQUIREMENT
- All Manufacturer or Importer, or AIR of all existing and new substances they have placed or intend to place in India in quantity greater than 1-tonne per year shall notify the authority.
- A Registration shall be done by submitting a Technical Dossier, and safety data sheet (SDS) and other information are listed as per norms.
- All Notifiers of notified substances must update the information submitted annually.
- Foreign Manufacturers may appoint an Authorized Indian Representative in India to represent their case and comply with the regulations and registrations. The AIR shall be an Indian national or entity registered in India.

PROCESS OF REACH COMPLIANCE CERTIFICATION
NOTIFICATION
- All Manufacturer or Importer, or AIR of all existing and new substances shall notify the authority.
- After that, the authority shall conduct a preliminary check to ensure that the Notification is complete and the prescribed fee has been paid.
- Once the Notification shall be deemed accepted, the substance shall be entered into the Register of Notified Substances.
- A notification number shall be assigned to the Notifier for such Substance, and a Notification Certificate/REACH Certificate of compliance shall be granted to the Notifier.
REGISTRATION
- All Manufacturer, Importer, AIR that have placed or intended to place a priority substance in quantities greater than 1 tonne per year must be registered. Registration may also be required for the substance in quantities lower than 1 tonne per year.
- A Registration shall be done by submitting a Technical Dossier as prescribed in Schedule VII. the authority shall conduct a preliminary check to ensure that the registration is complete and the prescribed fee has been paid.
- Once the registration shall be deemed accepted, a registration number is issued along with the registration certificate after successful submission.
- Foreign Manufacturers may appoint an Authorized Indian Representative in India to represent their case and to get REACH Certificate.
ANNUAL UPDATE
- All notifiers of notified substances must update the information submitted annually.
- Any changes or additions to the information submitted at the time of Notification must be updated within 60 days after the end of each calendar year.
