E- WASTE MANAGEMENT (EPR): Rapid advances in electronics technology over the last twenty-five years have dramatically enhanced quality of life, working conditions, and operational environments around the world. In recent years, there has been an increase in the usage and dependence on electrical and electronic devices such as cell phones, computers, laptops, televisions (CRT/LED/LCD), washing machines, refrigerators, and air conditioners, resulting in significant amounts of E-waste being generated.

The high rates of obsolescence of the above mentioned items coupled with steady rise in the demand have also resulted in substantial growth in e-waste generation. Electrical and electronic equipment (EEE) contains both valuable materials and hazardous/toxic compounds. It has also caused some environmental issues that, if not handled, may deteriorate into a scenario that will cause irreversible environmental and human health damage.

The Government of India (GOI) has supported many initiatives in response to the growing concern over e-waste. In 2011, the government established the first law, based on Extended Producer Responsibility (EPR), which holds manufacturers responsible for managing the final stage of a product's life cycle in an environmentally sustainable manner. Every producer/importer of electric or electrical equipment must have an Extended Producer's Responsibility (EPR) certificate or license. The fundamental features of the E-waste (Management and Handling) Rules, 2011, are extended producer responsibility (EPR).

It encourages producers to produce items that are environmentally beneficial. The Central Pollution Control Board (CPCB), which is part of the Ministry of Environment, Forests and Climate Change (MOEFCC), issues EPR Authorization. Manufacturers and importers must form a partnership with an authorized recycler to dispose of E-Waste and submit all plans relating to the expected dump quantity and disposal method to the CPCB in order to obtain an EPR Certificate, according to the standards. In other words, the product's maker is responsible for the final recycling, reuse, or disposal of the product.

E-waste is waste produced by used electronic gadgets and household appliances that are no longer fit for their intended purpose and are designated for recovery, recycling, or disposal. Such wastes include a wide range of electrical electronic gadgets, including computers, hand-held cellular phones, personal stereos, as well as major household appliances like refrigerators and air conditioners.


EXTENDED PRODUCER RESPONSIBILITY (EPR) AUTHORIZATION

We live in the digital era, and the use of electronic and information technology products is increasing all the time.The high rates of obsolescence of devices, along with a continual rise in demand, have resulted in a significant increase in E-Waste output. It has also generated some environmental difficulties, which, if not addressed, could lead to lasting environmental and human health damage. To handle E-Waste, the government of India has established law, based on Extended Producer Responsibility (EPR). Let’s discuss EPR in details.

Extended Producer Responsibility (EPR) is an environmental protection policy that holds the product's manufacturer liable for the product’s complete life cycle, including take-back, recycling, and final disposal. The responsibility of the manufacturers is thus extended to the post-consumer stage of the product life cycle. This needs to be incorporated into the regulatory framework, making EPR a required activity for the long-term production of electronic and electrical equipment.

Producers of notified equipment included in schedule I of the E-waste management regulation 2016 must obtain EPR authorization, which gives them authority to manage extended producer responsibility with the implementation plans and targets indicated in the authorization. According to the E-waste management rule of 2016, the CPCB has the authority to give, renew, or deny EPR authorization to electrical and electronic equipment manufacturers. Only such applications will be evaluated by the CPCB and granted EPR authorization within 120 days.

PROCEDURE FOR EPR AUTHORIZATION

Steps for submitting an EPR authorization application

1. Documentation: Before submitting the application, the applicant must compile all essential documents, including an EPR Plan, for EPR authorization.

2. Filling out an application form: The applicant must fill out a detailed application form with an EPR plan.

3. Offline application submission: For ETA, the applicant must submit an offline application to the concerned department with detailed information about the producer and an EPR plan.

4. Application scrutiny: A CPCB official will review the application, and the EPR plan will be examined by the CPCB for approval.

5. EPR approval: After scrutiny and approval of EPR plan, the divisional head issues the EPR authorization.


REQUIRED DOCUMENT FOR EPR APPROVAL

Along with Form-1, the following documents must be submitted:

1. Documents pertaining to the EPR plan.

3. Budgeted amount set aside for Extended Producer Responsibility (EPR)

4. Copies of the agreement document with dealers, collection centers, dismantlers, recyclers, treatment, storage, and disposal facilities (TSDFs), and so on.

5. Self-declaration of RoHS compliance.

6. Technical documentation (supplier declaration-product description, materials, parts, and/or sub-assemblies document, and analytical test result)

7. A copy of the applicable ministry/permissions/licenses department's for marketing various items or conducting business as follows:

  • TIN information
  • PAN information
  • Certificate of Incorporation
  • In the case of importers, a copy of the IEC

8. A copy of the SPCBs/PCCs' authorization
