WHAT IS FOREIGN MANUFACTURERS CERTIFICATION SCHEME (FMCS) BY BIS?

Every country has set different standards and rules for the manufacturing of products. The manufacturer can not launch a product directly into the market without product conformity compliances, testing, and marking.

In India, a BIS license is granted for products manufactured and conforming to all the relevant Indian standard requirements to use or apply Standard Mark. FMCS is a scheme under which a BIS license is granted to a foreign manufacturer to use or apply Standard Mark and sell their product in India. This scheme enables the foreign manufacturers to use the standard mark, also called ISI Mark, to sell their products in India.

BIS has operated the Foreign Manufacturers Certification Scheme (FMCS) since 2000 under BIS Act, 2016. The BIS license is granted for the products which conform to relevant Indian Standards developed by BIS. The FMCS Scheme is applicable for grant of license for all products except Electronics & IT Goods notified by the Department of Electronics & Information Technology.

REQUIREMENTS OF BIS CERTIFICATION

1. BIS License is mandatory for Foreign manufacturers who want to export their product in India.

2. For FMCS, the manufacturing unit should be located outside of India.

3. Foreign manufacturers must ensure their product(s) conform to applicable Indian Standards Specification (ISS).

4. All manufacturing machinery and testing facilities should be available at the factory premises.

5. Laboratory should be fully equipped with Product testing equipment and quality control personnel to test the product per applicable ISS.

6. The foreign manufacturer should accept the Scheme of Inspection & Testing and the annual marking fee, the terms, and conditions of the Licence.

7. All manufacturer needs to submit separate applications for each product, each factory location.

3. In-house Manufacturing capabilities and also outsourcing agreement of manufacturing operation, if applicable.

6. Laboratory testing report and other information as per BIS norm.

The average time for grant of license is generally six months from the date of receipt of complete application and its recording. Time may vary for reasons like delay in response to queries raised, organizing inspection, transportation of samples, remittance of dues, etc.
